These Terms describe how to access and utilize the Mintartes platform, including our APIs, mobile apps, and any associated live support, software, tools, features, or functionalities. They encompass the ability to view, explore, showcase, and generate NFTs, as well as using our tools for direct interaction with others to mint, purchase, sell, or transfer NFTs on public blockchains. In these Terms, "NFT" means a non-fungible token or a comparable digital item on a blockchain, such as the Ethereum blockchain, that uses smart contracts to link to specific content or data.

Please review these Terms of Service carefully as they contain crucial information and impact your legal rights. As detailed in Section 16, they include a mandatory arbitration clause and a class action waiver, requiring all disputes between us to be settled through individual arbitration, not in court with a judge or jury. By clicking to accept, sign, or use our service, you agree to these Terms and all referenced within. If you do not agree, you may not access or use the service.

Mintartes does not function as a wallet service, exchange, broker, dealer, financial institution, payment processor, money service business, or lender. Mintartes is a peer-to-peer web3 platform that enables users to explore and interact with each other and with NFTs on public blockchains. We do not hold or manage the NFTs or blockchains you interact with, nor do we facilitate NFT transactions, trades, or sales. To use our Service, you must have a third-party wallet that allows blockchain transactions.

Mintartes reserves the right to change or update these Terms at any time, at our discretion. If significant changes are made, we will try to inform you, such as by posting a notice on the Service or updating the "Last Updated" date at the top of these Terms. By continuing to use the Service, you agree to the revised Terms and all referenced terms, which will take effect on the date they are updated. It is your responsibility to regularly review the Terms to stay informed of any changes and understand the conditions that apply when you access or use the Site.

Accessing the Service
On Mintartes, your blockchain address acts as your identity, similar to other web3 platforms. Therefore, you'll need a blockchain address and a third-party wallet to use the Service. Your account ("Account") will be connected to your blockchain address, but you can customize your Mintartes profile by adding details like a profile picture. Mintartes is not responsible for your wallet use and does not guarantee compatibility with any specific wallet. You are fully responsible for keeping your wallet secure and should never share your wallet credentials or seed phrase. If you notice any security issues with the Service or your Account, please notify us immediately at support@mintartes.com.

Ownership
All other third-party trademarks, registered trademarks, and product names mentioned on the Service or linked to any NFTs shown are owned by their respective owners and cannot be copied, imitated, or used, in whole or in part, without the permission of the relevant intellectual property rights holder. Mention of any products, services, processes, or other information by name, trademark, manufacturer, supplier, or otherwise does not imply endorsement, sponsorship, or recommendation by Mintartes.

License to Access and Use Our Service and Content
You are given a limited, nonexclusive, nontransferable, nonsublicensable, personal license to access and use the Service, subject to your compliance with these Terms. If any software, content, or materials owned, controlled, or licensed by us are made available to you as part of your use of the Service, we grant you a non-commercial, personal, non-assignable, non-sublicensable, non-transferable, and non-exclusive right to access and display these materials (including downloading a single copy of the App onto your device), solely to enable your use of the Service as allowed by these Terms. Your license to any content linked to or associated with NFTs is as specified by the seller or creator of the NFT.

Third-Party Content, Agreements, and Services
As a peer-to-peer web3 platform, Mintartes allows you to explore NFTs created by third parties and interact with various blockchains. We do not provide any assurances or guarantees regarding third-party content visible through our Service, including content associated with NFTs displayed on the platform. It is your responsibility to verify the legitimacy, authenticity, and legality of NFTs purchased from third-party sellers. Additionally, we cannot ensure that NFTs showcased on Mintartes will always remain visible or available for purchase, sale, or transfer. Users are fully accountable for all content related to their NFTs.
These Terms exclusively regulate the use of our Service. NFTs exist on public blockchains and can be directly bought, sold, or transferred between buyers, sellers, and/or creators without involving our Service or agreeing to our Terms. Additionally, creators are solely responsible for any mint count and minting mechanics related to the NFTs they sell, where applicable. Mintartes may charge certain fees for its Service. However, we do not establish, collect, or determine other costs, fees, or expenses associated with purchasing and selling an NFT, including creator earnings, gas fees, or transaction fees.

User Conduct
You agree to comply with all laws, contracts, intellectual property rights, and other third-party rights. You are solely accountable for your actions and content while using the Service. Additionally, you agree not to:

• • Use or attempt to use another user’s Account without authorization from such user
• • Pose as another person or entity, or use a wallet to engage in a transaction on Mintartes that is owned or controlled, in whole or in part, by any other person;
• • Access the Service from a different blockchain address if we’ve blocked any of your other blockchain addresses from accessing the Service, unless you have our written permission first;
• • Distribute spam, including through sending unwanted NFTs to other users;
• • Use the Service – including through disseminating any software or interacting with any API – that could damage, disable, overburden, or impair the functioning of the Service in any manner;
• • Bypass or ignore instructions that control access to the Service, including attempting to circumvent any rate limiting systems, directing traffic through multiple IP addresses, or otherwise obfuscating the source of traffic you send to Mintartes;
• • Use our Service, including our APIs, in any way that conflicts with our developer policies;
• • Use our Service for commercial purposes inconsistent with these Terms or any other instructions;
• • Use any data mining, robot, spider, crawler, scraper, script, browser extension, offline reader, or other automated means or interface not authorized by us to access the Service, extract data, or otherwise interfere with or modify the rendering of Service pages or functionality;
• • Use the Service or data collected from our Service for any advertising or direct marketing activity (including without limitation, email marketing, SMS marketing, and telemarketing);
• • Use the Service to create, sell, or buy NFTs or other items that give owners rights to participate in an ICO or any securities offering, or that are redeemable for securities, commodities, or other financial instruments;
• • Create, display, purchase, or sell illegal content, such as content that may involve child sexual exploitation;
• • Create or display NFTs or other items that promote suicide or self-harm, incite hate or violence against others, or dox another individual;
• • Use the Service for any illegal or unauthorized purpose, including creating or displaying illegal content, such as content that may involve child sexual exploitation, or encouraging or promoting any activity that violates the Terms of Service;
• • Use the Service with the proceeds of unlawful activity or with a wallet used to engage in unlawful activity;
• • Use the Service in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Service.

Disclaimers
Your use of the Service carries inherent risks, and you acknowledge that accessing and using it is at your own risk. Mintartes provides the Service on an "as is" and "as available" basis, and expressly disclaims any warranties or conditions, whether express or implied. Mintartes and its suppliers do not guarantee that:

- The Service will meet your requirements;
- The Service will be available uninterrupted, timely, secure, or error-free;
- The Service will be accurate, reliable, complete, legal, or safe.

Mintartes also disclaims all other warranties or conditions, including but not limited to implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement. Mintartes will not be liable for any losses resulting from actions taken or reliance on material or information provided on the Service. While Mintartes strives to make the Service safe, we cannot guarantee that the Service, its content, content linked to or associated with NFTs, or any NFTs you interact with using our Service or our service providers' servers are free of viruses or other harmful components. We cannot ensure the security of any data you disclose online. Any advice or information obtained from Mintartes or through the Service does not create any warranty or representation not expressly stated here. By using the Service, you accept the inherent security risks of providing information and transacting online over the Internet, and you agree not to hold Mintartes responsible for any security breaches.

We are not liable for any losses or damages, and do not take responsibility for, any use or loss of use of NFTs, content, or content linked to or associated with NFTs, including but not limited to losses, damages, or claims arising from:

- User errors, incorrectly constructed transactions, or mistyped addresses;
- Server failures or data loss;
- Unauthorized access or use;
- Any unauthorized third-party activities, including the use of viruses, phishing, brute-forcing, or other forms of attack against the Service or NFTs.

Assumption of Risk
You accept and acknowledge:

• • The worth of an NFT is based on personal judgment and can vary widely. NFT prices can change unpredictably, and shifts in cryptocurrency prices can significantly impact NFT values in a negative way. By using NFTs, you recognize and accept the inherent unpredictability and potential for financial loss.
• • You agree that you are responsible for all fees connected with using the Service, including fees for blockchain transactions, even if they are unsuccessful. These fees are final and cannot be revoked.
• • A lack of use or public interest in the establishment and growth of distributed ecosystems may have a detrimental impact on the development of such ecosystems and related applications, hence reducing the potential utility of NFTs.
• • The regulatory regime governing blockchain technologies, non-fungible tokens, cryptocurrency, and other crypto-based items is uncertain, and new regulations or policies may materially adversely affect the development of the Service and the utility of NFTs.
• • Buying items linked to content created by third parties through peer-to-peer transactions carries inherent risks. These risks include the potential for purchasing counterfeit or mislabeled items, items vulnerable to metadata decay, smart contracts with bugs, or items that may later become untransferable. You confirm that you have conducted adequate research before deciding to buy, sell, transfer, or otherwise engage with any NFTs or accounts/collections.
• • We do not have ownership or control of the smart contracts deployed by third parties, and are not responsible and make no guarantees regarding their operation and functionality.
• • We have no control over the public blockchains with which you are engaging, as well as any smart contracts or protocols that may be required for you to conduct transactions on these public blockchains.
